How we used an eviction order to tackle noise and abusive behaviour in Wakefield
Sometimes injunctions don’t work and we have to go further and evict a customer. We see evictions as a last resort, and the courts do too as we’d rather be able to fix the issue for all involved so they can live happily at home. Evictions can take several months as everyone involved in the court process has to collectively reach a final decision.
Living next door to someone who’s continually causing problems, keeping you awake or having noisy visitors can make your life really difficult, so we try to speed up the process and support the person whose life is being affected as much as we can. Here’s Les’s story.
Les’s quality of life was being seriously affected by his neighbour, a heavy drinker who had no respect or compassion for the people living around him.
He played loud music at all times of the day and night and got angry and abusive when his neighbours complained. We tried to sort the problem by taking out several injunction orders, but he ignored them and carried on making life a misery for his neighbours.
So, the next step was eviction, but we needed to gather as much evidence as possible to take the case to court. Les, who was our main witness, went through a difficult year waiting for the legal process to finish, but he never gave up. He kept writing incidents down in his diary, he recorded the noise on our sound recorders and he ignored the shouting and outbursts from his neighbour.
Thanks to him, we had all the evidence we needed. We eventually evicted the problem customer and restored peace and quiet for our residents.
